|INS Filing Fees Change . . . Again
Effective February 27, 2003, INS filing fees will return to the pre-January 24 rates. Filing fees were originally adjusted to exclude applicable surcharges used for asylum and refugee services, fee exemptions and fee waivers. This reduction was mandated by provisions of the Homeland Security Act of 2002.
Congress has now repealed this section in passing the Homeland Security Act Amendments of 2003, which returns the fee schedule for immigration benefit applications to the levels that existed prior to January 24, 2003. As a result, all applications and petitions submitted on or after February 27, 2003 must include the appropriate pre-January 24 fee. Petitions and applications postmarked on or before February 27 will be accepted with the reduced fees.
